Important Changes Coming to Real Estate Practices: What You Need to Know

As a trusted real estate professional, it's my duty to keep you informed about the latest changes in the industry that could impact your buying or selling experience. Starting on August 17, 2024, significant updates are being implemented that will change how we conduct real estate transactions. These changes, driven by a national settlement agreement, are designed to enhance transparency and fairness in our industry. Here's what you need to know.

Key Changes to Real Estate Practices

  1. Offers of Compensation on MLS:

    • Starting August 17, offers of compensation will no longer appear on Multiple Listing Services (MLSs).
    • What This Means: While compensation offers will be removed from MLSs, sellers and brokers can still negotiate and offer compensation off MLSs. This could include a fixed-fee commission paid directly by consumers, concessions from the seller, or a portion of the listing broker’s compensation.
    • Negotiability Remains: Commissions and fees have always been negotiable, and this will not change. The new rules emphasize the importance of clear, negotiated agreements that protect both agents and clients.
  2. Written Agreements for Buyer Representation:

    • Agents working with buyers must now enter into a written agreement before touring a home. This agreement will clearly outline the amount or rate of compensation.
    • Clarity and Transparency: This change is aimed at promoting transparency and ensuring that buyers fully understand the compensation structure before any in-person or virtual tours take place. It does not, however, create a mandatory agency relationship.
