🚨 Federal Judge Dismisses Lawsuit Against National Association of REALTORS® (NAR)

In a significant legal victory for the real estate profession, a federal district judge has dismissed with prejudice the antitrust lawsuit filed by Homie Technology Inc. against the National Association of REALTORS® (NAR) and several large brokerages.

This decision upholds the role of REALTOR® organizations and affirms that the claims brought forward were legally insufficient to proceed.

🏛️ Case Summary:

The case, Homie Technology Inc. v. National Association of REALTORS®, was filed in August 2024 in the U.S. District Court for the District of Utah. Homie, a Utah-based real estate tech company, alleged that NAR and brokerages including Anywhere Real Estate, HomeServices of America, and RE/MAX conspired to restrain competition in violation of federal antitrust law.

However, Judge Dale Kimball ruled on July 15, 2025, that Homie:

“failed to plausibly plead an antitrust injury based on market foreclosure, exclusion, or barriers to entry.”

The judge found the allegations of boycotting lacked evidence showing that defendants actually participated in such activities. Because the case was dismissed with prejudice, Homie cannot refile these claims.

“NAR is pleased with the court’s ruling to dismiss the case with prejudice,” said NAR General Counsel Jon Waclawski. “NAR will continue to facilitate local real estate marketplaces that provide fair and equal access to property information, foster competition, and empower members to serve clients on their homebuying and selling journeys.”
